Early Access Pre-Order Terms & Conditions

Early Access Pre-Order Terms & Conditions

Last updated: 13 August 2026

We're excited to give our customers the opportunity to be among the first to receive our newest products.

Our Early Access Pre-Order programme allows you to reserve a new product before full-scale production and normal retail availability.

Because you're ordering early in the product's journey, please read the following terms carefully before placing your order.

1. What is an Early Access Pre-Order?

An Early Access Pre-Order is an order for a product that is not yet ready for immediate shipment.

At the time you place your order, the product may still be undergoing one or more stages of:

  • final product development;
  • engineering or design refinement;
  • tooling;
  • manufacturing setup;
  • material or component procurement;
  • production;
  • quality testing and inspection;
  • packaging preparation;
  • regulatory or compliance procedures; or
  • transportation to our fulfilment facilities.

Your payment reserves your product ahead of its general availability.

This is a retail pre-order and is not a crowdfunding contribution, investment or donation.

2. Estimated Shipping

Each Early Access Pre-Order will display an estimated shipping date or shipping window when you place your order.

For example:

Estimated shipping: November–December 2026

This represents our best reasonable estimate based on the production information available to us at that time.

It is an estimate rather than a guaranteed delivery date.

Creating and manufacturing a new product involves several stages, and circumstances outside our reasonable expectations may affect the schedule.

These may include manufacturing adjustments, tooling modifications, material availability, component delays, quality-control requirements, regulatory requirements, freight or logistics delays and other production-related circumstances.

3. We'll Keep You Updated

We want Early Access customers to be part of the product's journey.

As the product progresses towards launch, we may send you updates covering important milestones such as:

Development → Tooling → Manufacturing → Quality Inspection → Freight → Fulfilment → Shipping

The exact stages and frequency of updates will depend on the particular product.

If something important changes, we'll make reasonable efforts to tell you what has happened and what it means for your order.

4. What Happens if Production is Delayed?

New-product development and manufacturing do not always go exactly according to plan.

If we become aware that we cannot reasonably ship your product within the shipping timeframe communicated to you, we will notify you as required by applicable law.

Where possible, we'll provide a revised estimated shipping date or shipping window.

Depending on your location and the circumstances of the delay, we may also ask you to confirm that you would like to continue waiting for your product or give you the option to cancel your order for a refund.

We will comply with applicable consumer protection requirements concerning shipping delays, customer consent, cancellations and refunds.

Your statutory consumer rights are not affected by these terms.

5. Payment

Unless otherwise stated at checkout, payment is collected when your Early Access Pre-Order is placed.

Charging your payment method does not mean that the product has completed manufacturing or is ready for shipment.

Your payment secures your pre-order allocation subject to these terms.

6. Product Development & Changes

One of the reasons we offer Early Access is that you're joining us before the product reaches normal retail availability.

During the final stages of development and manufacturing, we may make reasonable changes to improve the product, manufacturing process, quality, reliability, packaging or regulatory compliance.

Final products may therefore have minor differences from early photographs, prototypes, renders, descriptions or specifications shown during the pre-order period.

We will not intentionally make a material change that fundamentally alters the product's principal purpose or function without informing affected customers and providing any cancellation or other rights required by applicable law.

7. Cancelling Your Pre-Order

If you change your mind before your product has entered shipment, please contact us at:

chromcherry@gmail.com

We will process cancellation requests in accordance with the cancellation rights applicable to your order and location.

Once an order has shipped, our normal Returns & Refunds Policy and any applicable statutory consumer rights will apply.

Nothing in these terms limits any cancellation, return or refund rights that cannot legally be excluded.

8. If We Cannot Complete the Product

We fully intend to manufacture and fulfil every Early Access Pre-Order we accept.

However, creating a new product can occasionally reveal unforeseen technical, manufacturing, regulatory or supply-chain issues.

If we ultimately determine that we cannot manufacture or supply the product, we will cancel the affected pre-orders and refund amounts paid for the unfulfilled product as required by applicable law.

9. Orders Containing Other Products

If you purchase an Early Access Pre-Order product together with products that are already available, your order may be shipped separately.

In some circumstances, available products may be held until your pre-order product becomes available.

Where possible, the applicable shipping arrangement will be displayed during checkout or communicated to you after ordering.

10. Keeping Your Shipping Information Up to Date

There may be several weeks or months between placing your Early Access Pre-Order and receiving it.

If your shipping address changes during this period, please contact us as soon as possible at:

chromcherry@gmail.com

We will make reasonable efforts to update your address before fulfilment begins, but we cannot guarantee that changes can be made after an order has entered the fulfilment or shipping process.

11. Pre-Order Communications

By placing an Early Access Pre-Order, you acknowledge that we may contact you with information necessary to manage and fulfil your order.

This may include:

  • production progress;
  • important product updates;
  • changes to estimated shipping dates;
  • requests for confirmation regarding a shipping delay;
  • address verification;
  • fulfilment updates; and
  • shipping notifications.

These are transactional communications relating to your purchase and are separate from optional marketing communications.

12. United States Customers

For customers in the United States, we will handle shipping estimates, delays, cancellations and refunds in accordance with applicable US consumer protection requirements, including applicable Federal Trade Commission requirements.

Where required, if we cannot ship within the timeframe communicated when you ordered, we will provide appropriate notice and the opportunity to consent to the delay or cancel the unshipped order for a refund.

13. United Kingdom Customers

For customers in the United Kingdom, these terms do not affect your statutory rights under UK consumer protection legislation, including your rights concerning delivery, cancellation, conformity of goods and refunds where applicable.

Where we have agreed an estimated delivery period with you, we will manage your order and any subsequent delay in accordance with applicable UK consumer law.

14. Other Countries

If you order from another country, you may have additional mandatory consumer rights under the laws applicable to you.

Nothing in these terms is intended to exclude or restrict rights that cannot legally be excluded or restricted.
